Welcome to EssayGenius. These Terms of Service govern your access to and use of the EssayGenius website, applications, and services (collectively, the Service). Please read them carefully before using our Service.

1. Acceptance of Terms

By accessing or using EssayGenius, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use our Service.

2. Description of Service

EssayGenius is an AI-assisted writing platform designed to help students with academic essays. Our Service provides:

  • AI-powered writing assistance and suggestions
  • Research and academic source discovery
  • Citation management and formatting
  • Writing feedback and improvement tools
  • Document storage and version history

3. User Accounts

You may use certain features of the Service without creating an account. However, to access the full functionality, including cloud sync and collaboration features, you will need to register for an account.

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept responsibility for all activities under your account
  • Immediately notify us of any unauthorized use of your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service without permission
  • Interfere with or disrupt the Service or servers connected to the Service
  • Transmit any malicious code, viruses, or harmful content
  • Harass, abuse, or harm another person through the Service
  • Impersonate any person or entity

5. Academic Integrity

EssayGenius is designed to assist your learning process, not replace it. Our AI tools are meant to help you brainstorm, research, organize, and improve your writing, while you develop your own ideas, arguments, and voice.

You are solely responsible for:

  • Ensuring your use of EssayGenius complies with your institution's academic integrity policies
  • Understanding and following your course's policies on AI-assisted writing
  • Properly attributing all sources and ideas that are not your own
  • Submitting work that represents your own understanding and effort

Important: EssayGenius does not guarantee that content created with our Service will be accepted by your institution or will not be flagged by AI detection tools. Academic policies vary widely, and it is your responsibility to understand and comply with them.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by EssayGenius and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.

7. Your Content

You retain ownership of all content you create using our Service. Your essays, notes, and other materials remain yours.

By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you. This includes:

  • Storing your content to provide cloud sync features
  • Processing your content with AI models to provide writing assistance
  • Creating backups to protect against data loss

We do not use your content to train our AI models or share it with third parties except as necessary to provide the Service.

8. AI-Generated Content

The Service uses artificial intelligence to provide writing suggestions, research assistance, and other features. You acknowledge that:

  • AI-generated content may contain inaccuracies, errors, or inconsistencies
  • You are responsible for reviewing and verifying all AI-generated content
  • Academic sources suggested by the AI should be independently verified
  • AI suggestions are recommendations, not definitive answers

9. Subscriptions and Payments

EssayGenius offers a subscription-based service.

Regarding paid plans:

  • Pro is offered on monthly, 4-month Semester Pass, and annual billing cycles
  • Subscription fees are billed in advance for the billing period you select
  • Paid plans may include a 14-day free trial, but a payment method is collected up front to start that trial
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refunds are provided in accordance with our refund policy

If you start a trial and do not cancel before it ends, your selected paid billing cycle begins automatically. We reserve the right to change our pricing with reasonable notice. Price changes will not affect your current billing period.

10. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination:

  • Your access to the Service will be immediately revoked
  • Your data will be deleted in accordance with our data retention policy
  • Local data stored on your device will remain unless you delete it

We may suspend or terminate your access if you violate these Terms or engage in any activity that we reasonably believe is harmful to the Service or other users.

11. Disclaimers

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESSAYGENIUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless EssayGenius and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including academic integrity policies
  • Content you create, submit, or share through the Service

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will first be attempted to be resolved through informal negotiation. If we cannot resolve the dispute informally, you agree that any legal action will be brought in the courts of England and Wales.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

The Last updated date at the top of this page indicates when these Terms were last revised.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
